Supreme Court denies interim order against Sudurpaschim government formation
Seeks documents related to appointment and schedules the case for final hearing.Post Report
The Supreme Court on Monday refused to issue an interim order as sought by the plaintiff in a writ petition filed at the court challenging the appointment of Dirgha Sodari as Sudurpaschim chief minister.
Hearing the petition filed by Laxman Kishore Chaudhary, leader of the Nagarik Unmukti Party, a single bench of Justice Bal Krishna Dhakal ordered the defendants to produce documents related to the appointment. The bench prioritised the petition and scheduled it for a final hearing.
“There is no necessity for an interim order; it is more suitable to resolve the dispute through a final hearing, given its nature,” the bench said in the order. “Present the petition for final hearing on May 5.”
On Sunday, Chaudhary moved the apex court demanding the nullification of the incumbent government in the province.
Sodari of the CPN (Unified Socialist) was appointed as the chief minister of Sudurpaschim Province on Thursday. Earlier, Sudurpaschim Province Head Najir Miya rejected the claims by Nagarik Unmukti Party’s Kailash Kumar Chaudhary and Laxman Kishor Chaudhary. Miya then extended the deadline till 5pm on April 18 to come up with a clear basis to obtain a majority with the backing of two or more political parties.
Laxman Kishor, in his petition, claimed that the Province Head had mala fide intent in extending the deadline, even as he already had the support of the majority members of the assembly.
