Supreme Court issues interim order not to cancel Toshima Karki’s candidacy

The Supreme Court on Tuesday issued an interim order to the Election Commission not to implement its decision to annul the candidacy of Dr Toshima Karki, who is a member of the Nepal Medical Council.
A single bench of Justice Kumar Chudal issued the interim order to the Election Commission following the hearing on the writ petition filed by Karki.
“Citing the possible irreparable damage to the writ petitioner an interim order has been issued in the name of defendants not to implement its decision to annul her candidacy until the final decision on the issue,” states the interim order issued by the Supreme Court.
Karki is contesting a federal lower house seat from Lalitpur-3 on a Rastriya Swatantra Party ticket.
On Monday, Karki had registered a writ petition at the apex court against the Election Commission’s October 29 decision to annul her candidacy.
Senior advocates Surendra Bhandari and Dinesh Tripathi and advocates Lalit Basnet, Bhimarjun Acharya, Om Prakash Aryal, Gokul Bhandari and Madhukumar Chaulagain had defended on behalf of petitioner during the hearing.
The Election Commission, which kept silent on the application filed by Karki on September 13 demanding the election body to clarify whether her position as an elected board member of the medical council was the position of benefit or not so that it would be easier for her to decide on whether or not to contest the polls, had abruptly decided on October 29 to annul her candidacy saying she was not eligible to contest the polls.
