A division bench of Justice Anil Kumar Sinha and Prakash Man Singh Raut on Friday directed the government to uphold the decision of the court and release Bhishwokarma. They also warned that failure to implement the ruling will be construed as contempt of court.
Bishwokarma’s brother, Birendra had filed a habeas corpus writ at the SC, arguing that his brother was being detained illegally.
Bishwokarma, who was first arrested in Dakshinkali, Kathmandu, on August 7 in an extortion charge, was cleared of the charge by the SC a week later. But he was re-arrested shortly after he was freed on a different charge. Since then, he has been freed and re-arrested for four times already.
