Contempt of court writ filed against IGP Aryal
A contempt of court writ has been filed at the Supreme Court (SC) against Inspector General of Police (IGP) Prakash Aryal.A contempt of court writ has been filed at the Supreme Court (SC) against Inspector General of Police (IGP) Prakash Aryal.
Senior advocate Dinesh Tripathi filed the writ against IGP Aryal on Tuesday for neglecting the SC’s verdict to arrest murder convict Bal Krishna Dhungel, a CPN (Maoist Centre) leader.
In the writ, advocate Tripathi has demanded action against IGP Aryal as per the law.
He has also demanded order from the SC to form a special taskforce to arrest Dhungel and submit the progress report within 24 hours.
Legal provision states that anyone found guilty in the contempt of court will be jailed for one year and will be fined Rs 10,000.
The hearing for the writ has been scheduled for tomorrow.
The SC on April 13 had ordered IGP of Nepal Police to arrest Dhungel and put him behind bars within a week.
A single bench of Justice Ananda Mohan Bhattarai had issued the order.
Responding to a contempt of court case filed by advocate Dinesh Tripathi on April 12, the apex court on the next day had asked the police chief to deploy all its resources, arrest Dhungel and present him before the court through the Department of Prison Management within a week.
The former Maoist lawmaker was found guilty of killing Ujjan Kumar Shrestha of Okhaldhunga in 1998.
The Okhaldhunga District Court in 2004 had convicted Dhungel of murder and ordered life term for Dhungel, but in 2006, the Rajbiraj Appellate Court gave him clean chit.
He was elected lawmaker in 2008 Constituent Assembly elections. The apex court in 2010 overturned Rajbiraj Appellate Court’s decision and upheld Okhaldhunga District Court’s verdict.
The Baburam Bhattarai government in November 2011 had recommended presidential clemency for Dhungel, but it was rejected by the court.
Despite the SC order, Dhungel has been walking free, largely due to the protection from his party.
