High Court nullifies Kathmandu Metropolis-PADT agreement on Gaushala operation

The Patan High Court has nullified the agreement between the Pashupati Area Development Trust (PADT) and the Kathmandu Metropolitan City regarding the operation of the Pashupati Gaushala Dharamshala.
The Marwadi Sewa Samiti Nepal had filed a writ petition against the agreement at the Patan High Court on October 18 last year. The court issued its verdict on Thursday, paving the way for the Marwadi Sewa Samiti to resume operation of the Gaushala Dharamshala.
The initial agreement between the Marwadi Sewa Samiti and PADT was signed on May 26, 2003. However, on August 2, 2023, PADT sent a letter to the committee, stating that the agreement had been terminated. In response, the Marwadi Sewa Samiti filed a case at the Kathmandu District Court. On October 2, 2024, the district court ruled against the committee’s claims.
Following this decision, PADT and the Kathmandu Metropolitan City signed a new agreement on October 8, 2024 to manage the Pashupati Gaushala Dharmashala. In response, the Marwadi Sewa Samiti filed a writ at the Patan High Court on October 17, 2024, requesting the annulment of the new agreement. The court’s order on Thursday has now invalidated the PADT-Kathmandu Metropolitan City agreement, restoring the Marwadi Sewa Samiti’s authority to operate the facility.
