Supreme Court issues interim order to prevent removal of foreign employment board executive director Uprety

The Supreme Court has issued an interim order preventing the removal of foreign employment board’s executive director Dwarika Prasad Uprety from his position. The single bench of Justice Bal Krishna Dhakal issued the order in response to the Ministry of Labour, Employment, and Social Security’s decision to relieve Uprety of his duties.
Uprety, appointed by the Council of Ministers on August 23, 2022, for a four-year term, had been served a three-day explanation notice by the ministry on October 22, 2024. Before the explanation period concluded, he was removed from his role, an action the Supreme Court deemed non-compliant with the Foreign Employment Regulations. The top court held that Uprety’s premature dismissal could constitute a violation of his rights, as his tenure was defined under administrative duties specified in the Foreign Employment Act, 1985.
The order mandates maintaining Uprety’s position in its original status until a final decision on the petition, prohibiting any actions that would implement the ministry’s dismissal letter.
