DIG Silwal performance report: SC orders action against guilty
Days after former Deputy Inspector General (DIG) of Nepal Police Nawaraj Silwal elected as a member of the federal parliament from Lalitpur-1, Supreme Court (SC) on Thursday has ordered the government to take action against those involved in forging his performance evaluation report.Days after former Deputy Inspector General (DIG) of Nepal Police Nawaraj Silwal elected as a member of the federal parliament from Lalitpur-1, Supreme Court (SC) on Thursday has ordered the government to take action against those involved in forging his performance evaluation report.
Issuing the full text of the decision on his writ petition, the SC has stated that the difference in the performance appraisal reports presented by the Public Service Commission and writ petitioner Silwal should be investigated and action should be taken against those involved in the forgery including the government authorities.
The verdict was given by the extended full bench of seven justices of the apex court that includes Chief Justice Gopal Parajuli, justices Kedar Prasad Chalise, Sharada Prasad Ghimire, Purushottam Bhandari, Prakash Man Singh Raut, Om Prakash Mishra and Meera Khadka.
In its full text the SC has hailed the government's decision and said interim order of the SC and giving highest priority to the writ petition was against the principle of jurisprudence developed by the SC itself.
On September 12, the then DIG Silwal had resigned from his position after the SC quashed his writ petition challenging the promotion of his colleague DIG Prakash Aryal to the post of Inspector General of Police (IGP).
DIG Silwal had moved the court for the second time challenging the government decision to promote DIG Aryal to the top post of Nepal police.
Silwal had argued that there have been irregularities during the review of the files on work performance of four DIGs who were contending for the top post.
He had claimed that the review panel deducted two points from his score sheet to promote Aryal to the post of IGP.
CPN Maoist Centre Chairman Pushpa Kamal Dahal-led government had picked Aryal as the Chief of Nepal Police on April 10 from among four contenders-Aryal, Nawaraj Silwal, Bam Bahadur Bhandari and Jaya Bahadur Chand-after reviewing the marks accumulated by the four top officials in the last four years based on their performance, qualification, seniority and prize, among others.
DIG Silwal had earlier knocked the apex court’s door on February 12 after the government decided to promote DIG Jaya Bahadur Chand as the new IG.
The SC on March 21 quashed the government decision to appoint Chand as the chief of Nepali Police and instructed the government to take into account seniority, merit and performance while promoting officials.
On the basis of the performance appraisal report submited by Silwal, the bench had also observed that “DIG Nawaraj Silwal has the highest marks” among the contenders.
