Vote count of the first phase local polls at ward no. 19 of Bharatpur Metropolis was halted after 90 ballot papers were torn allegedly by CPN (Maoist Centre) representatives on the night of May 28.
The EC had, on June 3, decided to conduct re-election in the ward.
A writ petition was filed at the Apex court by Gunjaman BK, a ward member candidate for Bharatpur-19, and Tulsiram Pandey, an advocate, against EC decision to conduct re-election in the ward 19, responding to which the SC had stayed the EC decision on June 5.
The SC decision had also sought the authorities concerned to maintain status quo on the decision until today.
It is learnt that a bench of Justices Bishwombher Prasad Shrestha and Prakash Man Singh Raut today could not move ahead with the case due to busy schedule.
SC spokesperson Mahendranath Upadhyay said that although the case was on the list of the Justices’ business today, hearing could not be convened due to the work pressure.
The writ has demanded scrapping the EC decision to conduct re-election in Bharatpur Metropolis and give continuity to vote counting.
