A full bench of the Supreme Court on Wednesday evening has summoned the federal parliament secretariat to inquire about the constitutional and legal bases of rendering the impeachment motion against suspended Chief Justice Cholendra Shumsher Rana ineffective.
General Secretary of Federal Parliament Bharat Raj Gautam submitted a letter on Wednesday morning to the concerned authorities stating that the impeachment motion of the suspended Chief Justice Rana was ineffective.
On Wednesday morning, Gautam sent the letter to the President’s Office, Prime Minister’s Office, Supreme Court, Judicial Council, Constitutional Council, and the Chief Justice’s Office.
The Supreme Court Bar Association on Wednesday filed a writ petition in the Supreme Court against Gautam’s letter citing that the letter goes against the constitution and the law, said Purna Man Shakya, president of Supreme Court Bar Association and senior advocate.
“The filed writ also mentions the Federal Parliament Secretariat,” said Shakya.
The hearing on writ petition filed by Shakya and others has been fixed for Friday, given that Thursday is a public holiday.
According to Anant Luitel, a member of the Supreme Court Bar Association, the writ petition states that an employee cannot nullify the jurisdiction of the sovereign parliament.
“An employee of the parliament cannot render the impeachment motion against Rana ineffective because the issue falls under the jurisdiction of the sovereign parliament,” Luitel said.
