A meeting of the CC presided over by Prime Minister KP Sharma Oli at his office in Singha Durbar this afternoon decided to recommend Mishra’s name to the top post of the judiciary.
According to the constitutional provision, a candidate for Chief Justice post is nominated from a group of Justices having at least three years of experience at Supreme Court. Justices Om Prakash Mishra and Cholendra Shamshar Rana are eligible for the Chief Justice.
The CC recommended Mishra as the Chief Justice on the basis of seniority.
Earlier, the Parliamentary Hearing Committee (PHC) had rejected the nomination of senior Justice Deepak Joshee as the Chief Justice on August 3. He is currently on a leave.
Senior Justice Mishra has been working as the acting Chief Justice of the Supreme Court after Joshee went on leave.
The Chief Justice is appointed by the President after the parliamentary hearing confirms the candidate nominated by the Constitutional Council.
