The men identified as cadres of CPN Maoist (Biplav) were charged with contempt of court.
A joint bench of justices Ananda Mohan Bhattarai and Anil Kumar Sinha today sentenced the duo—Prakash Shahi Prabal and Chandra Bahadur Budha—one-month in prison. The duo were arrested and taken into police custody on the same day after they smeared black soot on Kark’s face while the latter was returning after recording his statement at the SC.
In their clarification furnished at the court, the duo conceded their misdeed but denied having any deliberate intention to contempt the court. The apex court verdict said that no one can escape from their misconduct even if they deny their contemptuous act.
“Any physical attack or insulting attempt to the parties involved in the process of justice will be taken as intervention to the court’s proceedings,” the court ruled.
