Deuba-led Congress moves Supreme Court against Election Commission’s decision
The faction challenges the recognition of Gagan Thapa-led central committee, citing alleged violation of party statute and constitution.Post Report
The Sher Bahadur Deuba-led Nepali Congress has moved the Supreme Court, seeking to overturn the Election Commission’s recognition of the Gagan Thapa-led central committee.
Senior advocate Khamma Bahadur Khati said that a writ petition has been registered and an initial hearing has been scheduled for Tuesday. The petition argues that the special general convention, which elected Thapa’s committee, was unconstitutional and in violation of party statutes.
The Deuba faction has criticised the Election Commission’s decision, saying it goes against both the party statute and the constitution.
On Saturday, faction spokesperson Prakash Sharan Mahat said the group intends to pursue legal, constitutional, and political remedies to challenge the decision. “As the commission’s decision violates party rules, we have decided to seek legal remedies and oppose it politically,” Mahat said.
The Election Commission had on Friday granted legal recognition to the new central committee led by Thapa, elected through a special general convention held in Kathmandu between December 11 and 14. Supporters of the Thapa-led faction maintain that the convention was conducted according to party rules, while the Deuba camp continues to contest its legality.
