The motion, filed by 249 Nepali Congress and CPN (Maoist Centre) lawmakers at the Parliament Secretariat on April 30, however, was withdrawn on June 6, just a day before Karki’s retirement.
The first ever impeachment motion against a sitting chief justice was challenged at the Supreme Court, which on May 5 had stayed the move, paving the way for Karki to return to the court.
SC Spokesperson Mahendra Upadhyay said a division bench of acting Chief Justice Gopal Prasad Parajuli and Justice Prakash Man Singh Raut on Thursday decided to send the case to the constitutional bench, as it is related to constitutional issues.
Acting CJ Parajuli will form the constitutional bench to look into the matter.
