Province 2 State Minister Abhiram Sharma, who is accused in the murder of Armed Police Force (APF) Assistant Sub-inspector Thaman BK in Jaleshwor during the 2015 Madhes Movement, has been released on general date.Minister Sharma had surrendered before the District Court Mahottari at around 11 am earlier in the day.
A division bench of Justices of Janakpur High Court Madhav Prasad Pokharel and Rabi Sharma had issued a mandamus order in the first week of August, directing the district police and its chief to arrest the murder accused State Minister Sharma and Jaleshwor Municipality Mayour Ram Shankar Mishra. In its order, Janakpur High Court warned the District Police Office, Mahottarai to abide by the order and to not make a mockery of judiciary by defying the court directive.
The court recorded statement from Minister Sharma for around three hours following his surrender.
After recoding Minister Sharma’s statement, a single bench of Mahottari District Court Chief Judge BrajeshPyakurel presided over a hearing into the case.
Advocate GyanendraLalKarn, Ramesh Pandey and Devendra Thakur defended the case for Minister Sharma during today’s hearing; while government attorney SudipDangal pleaded the case for the plaintiff.
State Minister Sharma and Mayor Mishra had won the last year's elections from the ticket of RastriyaJanata Party Nepal.
Kaushal Raya, who was elected as the Province Assembly member from Mahottari constituency-4, is also a murder accused. Raya is the leader of Federal Socialist Forum Nepal.
Armed Police Force (APF) officer BK was lynched during the Madhes agitation on September 11, 2015.
The accused individuals had allegedly dragged the injured officer from an ambulance and murdered him while being rushed to Janakpur for treatment.
Following the incident, Thaman’s brother PremBahadur BK filed a complaint at the DPO, Mahottari against the 28 accused with their names.
Based on the complaint, the Mahottari District Court on March 10, 2016, ordered the police to present the arrested suspects before the court to take their statements and issued an arrest warrant against the other absconding suspects.
Thaman’s widow ShobhaGahatraj filed a writ petition at the Janakpur High Court on April 11, 2018 seeking a mandamus order as the DPO, Mahottari was reluctant to arrest the murder accused. She claimed that she filed the writ at the High Court after Mahottari police did not take any step to arrest the suspects.

Though the court had issued an order to arrest him last Tuesday, police have not been able to detain him. Sharma appeared before the court with his security guards at around 11 am today.
