The Kathmandu District Government Attorney’s Office has started gathering crucial documents in a complaint lodged against Rastriya Swatantra Party President Rabi Lamichhane, accusing him of holding a dual passport.

Acting on a complaint filed on Tuesday, the attorney’s office has sought documents from three government agencies related to Lamichhane’s citizenship and passport.

According to Chief Assistant Attorney Achutamani Neupane, the attorney’s office wrote to the Department of Immigration, the Kathmandu District Administration Office and the Department of Passport on Wednesday seeking necessary documents.

“Further process will move ahead following response from the agencies,” said Neupane.

Yuvaraj Poudel had submitted an application at the District Government Attorney’s Office in Kathmandu on Tuesday after the police refused to register the complaint that demands legal action against Lamichhane for holding a dual passport.

While he still had an American passport, Lamichhane in 2015 received a Nepali passport producing the citizenship he got in 1994, even though the citizenship certificate had been automatically invalidated in March 2014. After the court’s recent verdict, he has now surrendered his Nepali passport.

One who receives or attempts to get a passport or travel documents by submitting false details can be fined Rs200,000 to half a million rupees and imprisoned for one to three years or both, as per section 21 of the Passport Act.

If Lamichhane is found guilty, he might be barred from electoral politics for life.

Section 13 of the Act relating to the House of Representatives formation makes a person guilty of misuse of passport ineligible to contest elections. There are similar provisions relating to National Assembly and provincial assembly elections.
