Apex court issues short-term interim order in Dhaka Kumar Shrestha’s case

The Supreme Court on Monday issued a short-term interim order not to implement the decision of the Rastriya Swatantra Party to make Bindabasini Kansakar a member of the House of Representatives in place of Dhaka Kumar Shrestha.
The single bench of Justice Til Prasad Shrestha, hearing on the petition filed by Shrestha requesting to stay the decision to remove him from the post of a lawmaker of the lower House through an interim order, said that it will give a decision on the matter on May 19. The Supreme Court has called both sides for a discussion and will decide on whether to issue an interim order against the RSP’s decision to remove Shrestha from the post.
Until then Kansakar will not be able to perform her duties as a lawmaker.
On Monday, senior advocates Shambhu Thapa and Raman Kumar Shrestha had argued on behalf of the petitioner Shrestha.
Likewise, the apex court has also ordered to submit a written reply within 15 days if there is any basis for not issuing the order as requested by Shrestha.
The Supreme Court has also issued a show cause notice against the party’s Central Discipline and Conduct Committee, seeking clarifications for expelling party lawmaker Dhaka Kumar Shrestha.
Shrestha, who was elected a lower House lawmaker under the Proportional Representation category from the RSP, had been expelled from the party and had been stripped of his position after being embroiled in a corruption case.
A recording of a phone conversation between Shrestha and controversial businessman Durga Prasain was leaked on April 9, where the former was heard seeking financial favours.
Shrestha had moved the Supreme Court making the RSP Central Discipline and Conduct Committee as defendants and claimed that the actions taken against him were illegal.
