Supreme Court dept enforces pending orders
The Judgment Execution Directorate (JED) of Supreme Court (SC) has recovered around Rs 1 million and enforced pending jail term to over 200 individuals.
As part of the third strategic plan, the SC has formed teams led by JED to recover pending fines and arrest individuals who are yet to complete jail sentence. Among those sent to jail, six have jail term of over 20 years, including verdicts dating back to 1998.
The District Court, Banke, had handed 20 years jail term to Ram Sukh Chidimar and Dunni Sukh Chidimar in November 1998 after convicting them in rape cases. The duo had, however, been at large.
Likewise, JED has also arrested Ajit Khan Paithan of Sarlahi convicted for life on charges of human trafficking in June 1998.
The JED team also got hold of Bijaya BK in Banke who was sentenced to life by a trial court in September 11, 2011. The special team from JED also arrested Brij Nandan Rajbhar from Nawalparasi who had been handed life sentence on robbery charges in March 2011.
According to the proposal of the apex court, teams are to be deployed in Jhapa, Morang, Sunsari, Siraha, Saptari, Dhanusa, Sarlahi, Bara, Parsa, Nawalparasi, Rupandehi, Kapilvastu, Banke, Kathmandu , Lalitpur and Bhaktapur districts.
Earlier, the JED had written to police for arresting the defaulters. As per new provisions, JED squad, along with police and other concerned authorities, has the authority to arrest the defaulters. According to SC data, of the total 120,240 years jail term, 53,992 years of jail term is yet to be enforced.
Similarly, in terms of fines Rs7.08 billion is yet to be recovered. The apex court has also provisioned that defaulters of jail terms and fines would be barred from availing of facilities provided by the state.
JED officials pointed out that they continue to face logistical hurdles to accomplish their task. According to Mahendra Upadhya, Executive Director of JED they do not have enough human resource, nor do they have sufficient vehicles to perform their tasks effectively.
