Petition filed demanding revocation of MP status of Rabi Lamichhane

A writ petition has been filed against Rastriya Swatantra Party President Rabi Lamichhane at the Supreme Court, demanding revocation of his position as a lawmaker.
The petition, filed by Advocate Yubaraj Poudel, demanding the annulment of Lamichhane’s membership of the House of Representatives was registered at the apex court on Wednesday.
“Lamichhane contested the recent bypolls using the copy of the citizenship certificate that, according to the court’s January 27 decision, had been deemed invalid,” reads the petition.
Since the defendant was not eligible to contest the election as per the Constitution of Nepal, 2021 and the Election Commission Act, 2017, Lamichhane’s position as a member of the House of Representatives and all documents related to the same must be revoked, the petition further reads.
The petition also mentions that Lamichhane has been unable to submit the evidence that he has given up his American citizenship.
“One cannot contest for, hold, or be nominated for any political position until they can prove that the citizenship they hold has been obtained after the authorities have legitimised that they have renounced their previous citizenship.”
Lamcihhane, along with the Kathmandu District Administration Office, House of Representatives and Assistant Chief District Officer Rabindra Prasad Acharya, have been named as defendants in the case.
The said petition had been submitted to the court on May 8 but was rejected by the court. Then, the petitioner challenged the court’s decision, following which Justice Til Prasad Shrestha had ordered the court administration to register the petition.
The hearing on the petition has been scheduled for May 31.
