A full bench of judges headed by Chief Justice Sushila Karki, justices Deepak Kumar Karki and Sapana Pradhan Malla on Tuesday revoked its earlier directive to Office of Nepal Trust decision to return 15.1 ropanis of land to Prerana Shah.
Nepal Trust had, on May 24, 2005, taken possession of a plot of land in Chhauni area that Prerana received from her parents as a dowry.
Following the seizure, Prerana had moved the apex court in February 2015 with affidavits and testimonials that suggested the plot of land was awarded to her by her parents and that she was its rightful owner.
In a hearing on the case on June 2015, a division bench of former CJ Ram Kumar Prasad Sah and Justice Cholendra Sumsher Rana had ruled that the office brought the land under its ambit without her consent and nor did it provide her a chance to defend.
Office of Nepal Trust and Office of Attorney General on behalf of the Ministry of Land Reforms and Management had filed an application at the Apex court to review its earlier decision.
