16-point agreement challenged at SC
A writ petition has been filed at the Supreme Court against the recent 16-point agreement signed by four major political parties to resolve the contentious issues of the new constitution.Ekantipur Report
The writ was filed only after a single bench of justice Cholendra Shumsher JBR issued an order to register the agreement reached among the four parties, SC Joint Spokesperson Baburam Dahal said.
"Of the 16-point agreement reached among the Nepali Congress, CPN (UML), UCPN (Maoist) and Madhesi Janadhikar Forum-Loktantrik on June 8, point no 1, 2, 3, 5 and 13 are against the constitution," it is stated in the writ.
The assertion made in point 1, 2 and 3 for the formation of a Federal Commission to demarcate the borders of the provinces that would in turn prepare a report, on basis of which, the two-thirds majority at the parliament would take the final decision is against the Interim Constitution, it is stated.
The point number 5 of the agreement has been slammed as being in violation of the principle of equality and democracy. It is stated that the agreement on 275-member House of Representatives cannot be based on geography but demography with 165 parliamentary constituencies determined. Furthermore, it is mentioned that if the determination is not made on the basis of demography the votes cast by some will bear more importance and significance while votes by some other will be of lesser importance.
The attempt to register the petition by advocate Bijaya Kant Karna naming the Office of the Prime Minister and Council of Ministers as the defendant on June 12 had been rejected. The rejection was made reasoning that the petition was not a constitutional or legal question, but a subject of agreement among the political parties. RSS
