Neupane quits JC over Bar letter
Judicial Council (JC) member Upendra Keshari Neupane on Wednesday tendered his resignation to Chief Justice and Chairman of the council Ram Kumar Shah following differences
The umbrella organisation of lawyers had handed over a letter to Neupane along with another member Khem Narayan Dhungana on Tuesday, expressing dissatisfaction over their inability to perform task in line with the “spirit” of the Bar. The organisation had also maintained that the duo seek advice from the NBA before taking important decisions. “If I have to consult them on every matter what remains of my autonomy,” said Neupane, who was appointed JC member on NBA recommendation.
He has also informed Bar chief Hari Krishna Karki in writing about the resignation.
Sources maintain that Neupane had wanted to declare his resignation on the JC anniversary on December 18. But that could not happen as the JC had cancelled all speeches for the day.
Neupane’s resignation has thrown the ongoing justice appointment talks at the apex court into uncertainty, with the Bar indicating that the process would move forward only after his replacement takes office.
“There were instances where the JC could not take decisions on appointment after one of its member had taken ill. In this case, the individual has quit the post. I don’t think the process will move ahead,” said NBA General Secretary Sunil Pokharel.
He also informed that the Bar would soon call its executive meeting to select new candidates. “The JC is yet to inform us officially about the matter,” he said.
The justice appointment process has been stalled after the NBA protested the JC decision to issue public notice. The Bar maintains that such moves are unconstitutional, while the council insists it was a call for eligible candidates to replenish its roster.
