Mayor Balendra Shah files petition against CAAN at Patan High Court
Along with the mayor, ward and city police chiefs move the court against the aviation authority.Post Report
The Kathmandu Metropolitan City has filed a writ petition at the Patan High Court against the Civil Aviation Authority Nepal (CAAN) demanding the latter’s decisions be invalidated.
On June 16, CAAN had sought clarifications from Kathmandu Metropolitan Mayor Balendra Shah, ward 9 chair Ramji Bhandari, and city police Chief Rajunath Pandey, for removing fencing wires from the Sinamangal premises of the Tribhuvan International Airport without prior notice.
The petition, filed on Wednesday, states that the aviation authority’s move is invalid prima facie and claims it is unconstitutional and beyond its jurisdiction.
The petition, with the trio as plaintiffs, that has named the CAAN and CAAN director general as defendants, demands that the aviation authority’s order be invalidated.
Claiming that maintaining and conserving unoccupied lands and building recreational parks on the same falls under the jurisdictions of the ward office and the metropolis respectively, the plaintiffs have also demanded that the court order the defendants not to obstruct the city office’s work at the site.
“We request the court to issue warrants against the defendants ordering them not to obstruct the park construction work, being carried out by the municipality, at the place, until its completion,” reads the notice.
The petitioners have also demanded an interim order for the same.
