The ruling was issued on 25 August 2015. The Supreme Court made the injunction following a filing of writ petition urging the surrogacy be considered illegal until Nepal formulates laws on it. The petition contends that surrogacy exploits the bodies of women poor women.
Numerous same-sex couples arrive at Nepal for surrogacy pregnancies because of the ban on surrogacy in their own countries. The people who are halfway through the process will be unaffected by the decision. But the ruling will forbid the ones who are yet to begin it.
However, the verdict may not be final.
After India and Thailand imposed a ban on surrogacy pregnancies, Nepal has turned up to be relatively affordable option for surrogacy than other countries in the world.
The SC has ordered the government to act on the petition within 15 days. The translation of the ruling sent to various surrogacy agencies has asked multiple questions related to the rights of the future parents and surrogate mother on the child, the rights of the child and duties of the surrogacy agencies.
