The bill tabled by the government a week ago was endorsed unopposed at Parliament. A majority of Acts amendment on Saturday were transformed as per the federal provisions adopted by the constitution. They include the language of oath of President, Vice President and Prime Minister, remaining VDC as Village Council among others.
However, more than 100 Acts—a majority of them related to federalism—need to be drafted for the full implementation of the new constitution. The new legal provisions are required for the implementation of around half the fundamental rights, directive principles, state restructuring and various provisions related to state, provincial and local government. The Election Commission alone requires at least eight new Acts for the election of federal parliament, provincial assemblies and local bodies.
Similarly, new acts will be needed to set up seven inclusive commissions envisioned by the new constitution for empowering the marginalised communities. The new statute envisions to have Tharu, Dalit, Women, Muslim, Inclusive, Madhesi and Adibasi Janajati Commissions to address the grievances of different communities.
A majority of the new Acts or amendment to the existing ones have to be drafted by the Law Ministry, while some
will be drafted by the concerned ministries under its consent. The acts come into force only after their endorsement by Parliament.
